Privacy policy
In Britton & Churches Lawyers recognize the importance of privacy and the sensitivity of the information that we maintain in our database, particularly the personal information about individuals with whom we deal, are customers, users, partners, candidates, suppliers, or others.
As practicing lawyers and legal service providers, we have a professional obligation, ethical and legal to keep confidential the information we receive as part of our attorney-client relationship. In addition, we are committed to safeguarding the information we collect and/or process of the persons, whether natural or juridical.
Scope of the Policy
This policy applies to us, as custodians of the database and responsible for the processing of your personal data, and to the natural person or legal holder of the data.
Personal information refers to any information that identifies or can identify a person. The term "interested party" applies to the person, whose personal data are being processed. The data processing includes any handling of this information, regardless of the methods or procedures employed. This includes, among others, storage, disclosure, procurement, collection, removal, maintenance, modification, destruction and use of personal data.
Legal Basis
This Policy is based on the Law 81 of 26 march 2019 on the Protection of Personal Data and the Executive Decree 285 28 may 2021 that regulates.
The Law 81 seeks the protection of the rights of natural persons in relation to the use of their personal data, and it applies to all databases in the territory of the Republic of Panama that store personal data of national or foreign, or when the controller is domiciled in the Republic of Panama.
Definitions
Types of Data
- Personal data- Any information concerning natural persons that identifies or makes identifiable. We treat all personal data as confidential data.
- Confidential data: Those data which by their nature should not be of public knowledge or of unauthorized third parties, including those that are protected by law, confidentiality agreements or non-disclosure, in order to safeguard information.
- Sensitive data: One that relates to the intimate sphere of its owner, or whose improper use can lead to discrimination or involves a serious risk to this.
Storage
- Data storage: Preservation or custody of data in a database set up in any means provided.
- Database: Ordered set of data of any nature, which allows us to relate the data between themselves and perform any type of processing or transmission of these by your custodian.
- Open source: Databases for public access, such as publications, state, means of communication, telephone directory, among others.
Participants
- Holder of the data: Natural person or legal entity to which the data relate.
- The custodian of the database: Natural person or legal entity who acts in the name and for the account of the controller and is responsible for the custody and preservation of the database.
- Responsible for the data processing: Natural person or legal entity that makes decisions related to the treatment of the data and determines the purposes, means and scope of the same.
Data processing
- Data processing: Operations that allow you to collect, store, record, organize, develop, select, extract, confront, interconnect, associate, disassociate, convey, assign, exchange, transfer, convey or cancel data, or use them in any other form.
- Consent: Manifestation of the will of the owner of the data, to allow your treatment.
- Data lock: Temporary restriction of any access to or treatment of the stored data.
- Termination or deletion of data: Suppression or permanent deletion of data stored in databases.
- Modification of data: Any change in the content of the data stored in databases.
- Dissociation procedure or anonymisation: Data processing that keeps the information available in the database can be associated to a natural person determined or determinable.
- Transfer of data: To make known, disclose, communicate, exchange and/or transmit the data to natural persons or legal entities other than the holder, whether certain or uncertain.
Collection and Use of Personal Information
We collect personal data as part of our professional activities in order to serve our customers and comply with the legal provisions applicable. These data include, but are not limited to:
- Basic information identification: Full name, date of birth, nationality, passport number or id.
- Contact details: Physical address, email address, phone numbers.
- Information in order to comply with the policy, Know your Customer: Copy of your identification document, proof of residence, certificate of existence or equivalent to legal persons.
Pages, portals and Internet service
If you provide us with your contact details via our online contact form, we will use your information only to respond to your query. If not, concrete is in a relationship with you, your data will be discarded after a reasonable period of time.
Social Networks
When you visit our social networking accounts, you agree to the data protection policies of these platforms. We do not collect data nor do we offer advice through social networks.
Information security
We implement safeguards physical, electronic, and procedural to ensure that your information is kept confidential and secure. Access to your information is restricted to employees authorized and trained.
Exercise of ARCO Rights
To exercise your rights of Access, Rectification, Cancellation and Opposition (ARCO), you must send a formal request to Britton & Churches Attorneys at the e-mail info@brig.com.pa. You can also exercise their rights by filing a formal request in our offices.
The application, whether sent by e-mail or in person, you must meet the following requirements in order to provide you with a timely response:
- Provide the following information:
- Names and full names.
- E-mail address.
- Contact telephone numbers (landline and cell).
- The means by which you wish to be contacted by Britton & Churches Lawyers in response to your request.
- Country, State/Province.
- Attach a copy of their personal identification document (identity card or passport).
- In case you are represented by an attorney, provide the power that authorises it to carry out the process.
- Provide a clear and precise description of the personal data for which you wish to exercise any of your ARCO rights, to withdraw the consent to or refuse the use of data for secondary purposes.
- Provide the information or document may assist in the processing of the application, for example, the attorney who provided the service, the area of the firm that provided the service, the procedure that was carried out, among others.
The response to its request shall be made within a maximum period of 10 days days from the date of receipt of your request. When the request is related to the modification of the information that Britton & Churches Lawyers maintains about you, the maximum period shall be 5 business days.
Changes in Policy
We reserve the right to modify this Policy at any time. The amendments will be notified to you through our web site and other means of contact. We encourage you to review this Policy periodically to be aware of any changes.
